Any person requesting a permit for a banner sign, for which a sign permit is required, shall submit to the City of Tacoma Washington Director of Public Works a written application for such vinyl banner permit. The Director will prepare a banner permit application submission form and provide it to any person or persons on request. The same identical form can be used for both the application process and the decision thereof. A single form should be used for multiple banners and signs on the same site. A banner permit application is considered complete only when it is submitted with the appropriate application fee, in the amount set forth by Town Council. In the case of post-fact-o that permitting, the otherwise applicable fee will be doubled. The form will call for the following information:
(1) Name and address of the applicant and, if applicable, the name and telephone number, as well as the license identification number, if any, of the banner maker;
(2) Address and district of the proposed property where the vinyl banner is to be displayed;
(3) Accurate dimensions showing the location of parking areas, driveways areas and wires, and proposed banners on the site; as to existing banners, information as to whether or not each is in need of permitting or is exempted from permitting;
(4) Accurate structure and/or fence and building showing existing vinyl banners, and accurate and scaled building elevations showing existing and proposed banners, including birthday banners, happy birthday banners, and various team banners of several graphic designs which are located elsewhere on the property;
(5) Existing banner area of each vinyl banner and the combined area of all proposed banners (including those which have already been in existence or previously permitted) in relation to the stated maximum allowed banner area;
(6) Written evidence of all owner/owners consents, such as land lessor;
(7) A statement as to whether or not the banner is intended to be used in part or in whole for off-site advertising messages, advertising for hire;
(8) Any statement or description as to whether the proposed banner, or any part of it, will utilize any of the following physical presentation methods: odor, smoke, fumes or steam; moving or animated elements; neon; fluorescent or day-glow type colors; liquid crystal displays or other video methods; use of animals or living persons;
(9) A statement specifying whether or not specific permitted use for which the vinyl banner is proposed to be erected and/or displayed, or any previously existing banner thereon associated with permitted use, is necessarily the subject of any outstanding notification of zoning violation or correction notice, including whether or not any such deficiencies are going to be remedied by the proposed application;
(10) Photographs of the previously existing property, parcel and/or building or structure on which the banners signs is proposed to be displayed;
(11) In the case of any proposed vinyl banner which is subject to a decision-making process, such as a sign variance, conditional use permit, or banner maker program, all information which is required by such process or processes
(12) The City of Tacoma Washington Dir. is authorized to modify the information to be provided on a banner permit application; however, amendments and additions may be made only after thirty 30 days public notice.
Completeness.
The Director must determine whether the proposed application contains all the required information. If found that the application is not complete, then the applicant shall be notified in writing and within 30 days of the date of receipt of proposed application; the notice shall further state the points of incompleteness as well as identify any additional required information necessary to complete the application after which the applicant will have 1 opportunity, within thirty 30 days, to submit the additional information required to render the application complete; failure to complete such application within the 30 day period will render application void.
Disqualification.
No vinyl banner application will be approved if:
(1) The proposed applicant has installed a vinyl banner in violation of provisions set forth within this chapter and, at the submission time of the application, each illegal and/or non-permitted vinyl banner has not been legalized, or included in the application;
(2) There are other existing zoning code violations located on the proposed site of vinyl banner(s) with the same permitted use (other than an illegal/nonconforming banner that is not owned or partially controlled by the applicant and is located within a different establishment) which has never been cured at the time of the proposed application, unless the alleged noncompliance is proposed as part of the application;
(3) The banner, including any party banner application is the same as an application already denied, unless:(12) months have passed since the last date of the final application, or (2) evidence or proof of conditions changing is furnished in the newly submitted application;
(4) The applicant has not received any applicable required subject use permit or conditional use permit. That, However, applications for such banner permits may be processed together with a banner permit application.
