Nonconforming Signs and Banners.
The following vinyl banners may be removed as a public nuisance:
(1) Any vinyl banner by virtue of its physical makeup, becomes an serious and impending threat to the public safety and well-being;
(2) Any banner, including outdoor banners which are erected and/or maintained in violation of the provisions set forth in Spokane Washington's Municipal Code
(3) Any banner which will no longer be advertising or no longer relates to the establishment on co-located premises;
(4) Any banner which has fallen into disrepair or takes has a dilapidated appearance.
Abatement.

(10) No approval of a vinyl banner variance shall be construed as a finding that a banner complies with any requirements except those specifically set forth in Chapter D. subsection W., nor shall any approval constitute a nominal waiver of any such previous requirements; and
(11) A application for variance shall include all the required information for a vinyl banner permit, as detailed in Section D., as well as any other information which may be required by State or City law pertaining to the variances.
Banner Programs.
When a residential or nonresidential development involving 5 or more leaseable units is proposed, a unified program for banner design is included, such program may occasionally deviate from the otherwise useful rules regarding the benign aspects of vinyl banners. However, such may not violate any of the provisions of the general plan, and may not authorize a banner design type which can be considered expressly prohibited by this chapter. Any message substitution policy will apply automatically to all vinyl banner programs.
(12) All banner program proposals shall be approved only by the Spokane Washington Planning Commission, with no recourse except they are appealable to City Council. Banner programs may be considered with the other aspects of development. The City Planning Commission may consider a proposed banner exchange program at a duly noticed public meeting at which evidence is taken and a written decision is provided.
